A reading of the Personal Status Law at a scientific seminar on private law in El Alamein

On Saturday, November 15, 2025, the Private Law Department at Al-Alamein Institute for Graduate Studies organized a scientific seminar entitled “A Legislative and Jurisprudential Reading of the Personal Status Code.” The seminar was presented by Professor Dr. Miri Kazem Al-Khaikani, Dean of the College of Law at the University of Babylon and a lecturer at Al-Alamein Institute. He addressed the topic of marital rights in the Personal Status Code, explaining the rights of both spouses and clarifying that the Code was not intended to strengthen the husband over the wife, but rather contained fair provisions for both parties.

Dr. Muhammad Qasim Al-Haboubi, a professor at the Islamic University, also lectured at the seminar, addressing the topic of guardianship in marriage contracts and explaining its provisions. He clarified that guardianship is designed to respect women's rights, especially if they wish to marry a suitable and beneficial partner. He explained that if a guardian refuses to consent out of obstinacy, his guardianship can be revoked. Following him was Dr. Safaa Mutab Fajja from the College of Law at Al-Qadisiyah University, who discussed divorce according to the provisions of the Family Code. He explained its rulings and highlighted the provisions of the Family Code regarding the annulment of marriage contracts, which was previously unclear in the Iraqi Personal Status Law. The seminar was moderated by Professor Ibrahim Ismail Al-Rubaie, Head of the Private Law Department.
